1. Acceptance of Terms

By accessing and using Yexil (hereinafter "the Service", "the Platform" or "we"), you agree to be bound by these Terms of Use. If you do not accept these terms, please do not use the Service.

2. Service Description

Yexil is a SaaS (Software as a Service) management platform for hotels and restaurants, offering the following features:

• Booking and room management
• Point of sale (POS) system
• Stock and inventory management
• Billing and collection
• Staff management and scheduling
• Reports and dashboards

3. Registration and Account

3.1 Eligibility

To use Yexil, you must:

• Be at least 18 years old
• Be legally authorized to enter into contracts
• Provide accurate and complete information

3.2 Account Security

You are responsible for:

• The confidentiality of your credentials
• All activities carried out from your account
• Immediately notifying Yexil in case of unauthorized use

4. Acceptable Use

4.1 You agree NOT to:

• Violate applicable laws and regulations
• Use the Service for illegal or fraudulent purposes
• Attempt to gain unauthorized access to Yexil systems
• Interfere with the operation of the Service
• Collect data from other users without authorization
• Reproduce, copy or resell the Service
• Use the Service to harass, threaten or harm others
• Transmit viruses, malware or malicious code

4.2 Multi-tenancy

You acknowledge that Yexil is a multi-tenant platform. Your data is isolated from that of other users and will never be shared without your explicit consent.

5. Intellectual Property

5.1 Yexil Property

Yexil and all its content (software, designs, texts, graphics, logos, interface) are the exclusive property of Yexil Dev and are protected by intellectual property laws.

5.2 Your Data

You retain all rights to the data you create or import into Yexil. We use your data only to provide you with the Service, in accordance with our Privacy Policy.

5.3 Limited License

We grant you a non-exclusive, non-transferable and revocable license to use Yexil for the duration of your subscription.

6. Service Availability

6.1 Availability Commitment

We strive to maintain the Service available 24/7 with an availability target of 99.9%. However, we do not guarantee uninterrupted availability.

6.2 Maintenance

Scheduled maintenance may cause temporary interruptions. We will inform you in advance where possible.

7. Technical Support

We provide technical support by email (info@yexil.pro) with a 24 business hour response time for pioneer partners.

8. Service Modifications

We reserve the right to:

• Modify, suspend or discontinue all or part of the Service
• Add or remove features
• Modify these Terms (with prior notice)

9. Termination

9.1 By You

You may terminate your account at any time by contacting us. Termination will take effect at the end of your current billing period.

9.2 By Us

We may suspend or terminate your access immediately in case of:

• Violation of these Terms
• Non-payment of subscription fees
• Fraudulent or abusive use of the Service
• Harmful behavior towards other users or our team

9.3 Effects of Termination

In case of termination:

• Your access to the Service will be immediately interrupted
• Your data will be retained for 30 days then deleted
• You may request an export of your data before deletion

10. Limitation of Liability

To the extent permitted by law:

• The Service is provided "as is" without warranty of any kind
• We are not liable for loss of revenue, data or business opportunities
• Our liability is limited to the amount of fees paid over the last 12 months
• We are not liable for problems caused by third parties (internet outages, payment providers, etc.)

11. Indemnification

You agree to indemnify and defend Yexil against all claims, losses, damages and expenses (including legal fees) resulting from:

• Your use of the Service
• Your violation of these Terms
• Your violation of a third party's rights

12. Force Majeure

We will not be held liable for any delay or failure to perform resulting from circumstances beyond our control (natural disasters, wars, strikes, widespread outages, etc.).

13. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Republic of Senegal. Any dispute will be subject to the exclusive jurisdiction of the courts of Dakar, unless otherwise required by mandatory provisions.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Yexil regarding the use of the Service.

14.2 Severability

If any provision of these Terms is found invalid, the other provisions will remain in effect.

14.3 Waiver

Failure to exercise a right does not constitute a waiver of that right.
